NEW ISSUANCE OF WORK PERMIT

1. What is a work permit?

Work permit or more precisely a work permit for foreigners working in Vietnam. This is a type of document issued by a competent authority in Vietnam to foreign workers when they meet certain conditions as prescribed by law.

Foreign workers who are granted work permits are considered to work legally and have their legitimate rights and interests protected in labor relations.

The English work permit is Work Permit, or Vietnam Work Permit (Vietnamese Work Permit) to make it easy to distinguish it from other countries that also issue this type of document.

2. Situations where a work permit is required

According to Vietnamese law, the implementation of work permit procedures applied to foreigners working in Vietnam includes the following subjects:

  • Foreign workers coming to Vietnam to perform labor contracts;
  • Foreign workers moving within the enterprise;
  • Foreign workers perform various types of contracts or agreements on economics, commerce, insurance, finance, banking, science and technology, culture, education, sports, vocational education and medicine. economic;
  • Contracted service providers;
  • Foreign workers come to Vietnam to offer products and services;
  • Foreign workers working for international organizations in Vietnam, foreign non-governmental organizations permitted to operate in accordance with Vietnamese law;
  • Volunteers;
  • The foreign worker is responsible for establishing a commercial presence;
  • Executives, managers, experts, foreign technical workers;
  • Participating in the implementation of projects and bidding packages in Vietnam;

3. Conditions for granting work permits to foreigners working in Vietnam

  • Having full civil act capacity in accordance with the provisions of Vietnamese law (From 18 years of age or older, without mental illness or diseases affecting cognitive ability);
  • Having health in accordance with the declared job requirements;
  • Working as an executive director, manager, expert or technical worker while working in Vietnam;
  • Not subject to criminal acts or being examined for penal liability according to the current provisions of Vietnamese and foreign laws;
  • To be approved in writing by the competent State agency on the employment of foreign workers.

4. Procedures for applying for a work permit

  • Judicial Records;
  • Health certificate at one of the hospitals such as Cho Ray, Thong Nhat, Phap Viet, 115, Van Hanh, Columbia…;
  • Written certification of experts or certificates of 3-5 years of experience;
  • Degree;
  • Photo 4x6cm;
  • Passports of foreign workers;
  • Certificate of business registration;
  • Labor contract;
